OFFICIAL RULES - VIEW short film contest

PARTICIPANT DISCLOSURE: NO MEMBERSHIP, PURCHASE, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.

1. The Contest: Prepare an original 30 to 60-second video that will educate the general public about the importance of protecting and preserving our oceans, waves and beaches under the theme of "buy a better future". Examples: your video could show how purchases of specific project BLUE products from our partners goes to help our oceans, waves and beaches; that we can make smarter choices at the counter; that our coastlines are an important resource and we are responsible for their well being; or anything else to help educate the public about responsible consumerism. The video must also reference the name, and/or website address and/or logo of project BLUE and Surfrider Foundation, the nonprofit environmental charity benefiting from this contest, and to assist viewers who want further information. The sponsor and administrator of this contest is Propaganda Headquarters, Inc., 31014 South Coast Hwy, Laguna Beach, CA 92651, www.propagandahq.net.

2. Agreement to Rules: By entering this contest, you agree to all of the rules. All decisions regarding the contest will be made by Propaganda Headquarters, Inc. in its sole discretion, and are final.

3. Eligibility: Except as noted in this section, this contest is open only to individuals who are legal residents of the United States who are 18 years of age or older. You do NOT have to have to be a Surfrider Foundation member to enter this contest. Not valid where prohibited. Employees, officers or directors of Propaganda Headquarters, Inc. (PHQ) are not eligible.

4. Originality and Rights: ALL ENTRIES MUST BE YOUR OWN ORIGINAL WORK AND CANNOT CONTAIN ANY COPYRIGHTED OR PREVIOUSLY PUBLISHED MATERIALS. By submitting your short film, you are promising that you own all rights to all material in your video, including the music, images, script, and rights to include all persons, places or organizations included or depicted. If your video contains images or identifications of any persons or organizations (other than project BLUE and Surfrider Foundation), you agree that, if you are chosen as a finalist, you will submit written authorization from those persons (or their parents or guardians) or organizations for the use of their identifications or images in your video. All submissions will become the property of PHQ, and you agree to transfer all rights in your work to PHQ and waive any future claims against PHQ or others from the use, derivative or otherwise, of your video. PHQ will have all rights to use your work in any way without any future notice, compensation or approval. You also agree to allow PHQ to use your name, identification, and likeness to use, promote or publicize your video in any manner, without limitation, and without further compensation. You agree to indemnify PHQ, including for legal costs, against any challenges to the ownership, use of, or rights to material in your video.

5. What Your Video May Contain: PHQ intends to use these videos to educate the public about project BLUE and its initiative to raise awareness and funds for the Surfrider Foundation via product sales. Video content should be both educational and entertaining, as well as original and never before offered on any other public site.

(A) You are free to use any reasonable genre or form of content, including humor, music, drama, documentary, autobiography or animation.

(B) Your video must focus on project BLUE and its environmental initiative for the Surfrider Foundation: the initiatve, non-profit benefiting from project BLUE efforts, or related environmental topics as found on www.surfrider.org.

(C) Your video must include audio and/or visual reference to project BLUE, including its name ("project blue") and/or tagline ("be true to blue") and (website address (www.betruetoblue.com, which can be spoken as "be true to blue dot com") and/or the project BLUE logo. You are authorized to use the project BLUE logo in your video; you can download the project BLUE logo by visiting the resources page on this website. Neither the project BLUE and Surfrider Foundation contact information or logo may be used in a manner which disparages or harms project BLUE or Surfrider Foundation.

6. Content Limitations: Videos must be in English. Submissions must not contain offensive, sexually-oriented, or defamatory statements. You may only submit one video.

7. Judging:

(A) Videos will be judged as follows: 45% on overall effectiveness at conveying an important message to the public about Surfrider Foundation; 40% on how original and creative the presentation is; and 15% on how effectively and creatively the video includes reference(s) to project BLUE and the theme of "buy a better future".

(D) Videos which do not comply with these rules in any way will be disqualified, in PHQ's sole and final discretion, without notice.

(E) By March 15, 2008, PHQ will select 10 videos as finalists for a public viewing and comment period of 10 days. PHQ reserves the right to select additional finalists if their scores are close to the top twelve and add special recognition categories. If your video is selected as a finalist, you will be required to submit more information, authorizations, and copies of your video. All finalist entries will be available for viewing on project BLUE's VIEW web site. The public may be asked to rate the finalist videos on effectiveness of the message and attractiveness as a way to educate the public. All public comments received during the open viewing period will be considered when PHQ chooses the grand prize winning video.

(F) PHQ will choose a single grand prize winning video from the finalists.

(G) In the event of a tie, the entry that is the most technically proficient and professional in its appearance will be declared the winner.

8. To Enter the Contest: The contest Submission Period starts at 6:00 am EDT on Nov 11, 2008 and ends at 11:59 pm EDT on March 15th, 2008. Entry is a two-part process; YOUR ENTRY IS NOT FINAL UNTIL BOTH STEPS ARE TAKEN AND YOU HAVE RECEIVED AN E-MAIL CONFIRMATION OF YOUR ENTRY FROM PHQ.

(1) First, you must submit your video entry to the VIEW by project BLUE Group Channel on YouTube, by visiting www.youtube.com and uploading your video to the VIEW by project BLUE Group channel at www.youtube.com/groups/projectBLUE. You will have to comply with all terms, conditions and registration requirements of YouTube, although YouTube has no connection with PHQ, project BLUE or this contest. One requirement is that your video must be in the .wmv, .avi, .mov, or .mpg file formats. All technical issues involving YouTube and uploading videos should be directed to their webmaster.

(2) Once your video has been uploaded and approved for viewing, YouTube will provide you a link to your video. You must then visit the contest registration page here, complete the entry form, and agree to the contest rules. Your entry is not complete until you have received an e-mail acknowledging your entry; if you do not receive an e-mail within five days of your entry, please contact PHQ at info@betruetoblue.com.

9. Prizes: PHQ will award one Grand Prize of a trip to Costa Rica with accommodations. PHQ will also award each other finalist with project BLUE products from our project BLUE partners. Full prize packages can be viewed here. Winners will be notified and must complete final releases and information requests prior to fulfillment of the prizes. Failure to respond to the information requests or otherwise timely comply with all rules or requests from PHQ will void the award, and the prize may then be awarded to another entrant.

10. Additional Conditions and Terms:

A) As a condition for entry, you agree to release, waive, indemnify, and otherwise hold harmless PHQ, and all persons and entities associated with it from any liability associated with your video and this contest to the fullest extent of appropriate state or local laws.

B) All taxes are the responsibility of the winner.

C) You agree to comply with all government laws and regulations.

D) ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, PHQ RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Any damage made to the Web Site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry.

(E) PHQ is not responsible for errors of any kind, technical hardware or software failures of any kind, including any injury or damage to any person's computer, related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit your ability to participate in the promotion.

(F) PHQ reserves the right to cancel or modify the contest if fraud, misconduct or technical failures harm the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by PHQ, in its sole discretion. In the event of termination, a notice will be posted online and entries will be judged from among all eligible entries received prior to termination. If insufficient entries are received, or if no entry submitted meets minimum reasonable criteria for a prize, in PHQ's sole and final discretion, fewer than all awards may be made or a Grand Prize winner may not be selected. If at least one qualifying entry is made, at least one finalist award will be made.

(G) Proof of submitting entries or responses to inquiries will not be deemed to be proof of receipt by PHQ. Only receipt of an e-mail from PHQ acknowledging an entry or communication will be considered proof of submission.

(H) Any use of robotic, automatic, programmed or like methods of participation will void all such submissions by the entrant.

(I) PHQ reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.

(J) Once submitted, an entry is final and may not be altered or edited further. Duplicate entries will disqualify all such entries.

(K) No submissions will be returned.

(L) PHQ may use any and all information obtained from entrants for its internal activities, including contacting an entrant. PHQ may share this information with others, but will not sell this information to others.

(M) This Contest is offered only in the United States and is governed by the laws of the State of California. All claims relating in any manner to this contest or to any submission must be resolved in the federal or state courts of Orange County, CA. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participants and PHQ in connection with the contest, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California.

(N) PHQ is not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk.

(O) For the names of the Finalists or Official Rules, send your request with a self-addressed, stamped envelope postmarked by March 31, 2008 and received by April 15, 2008, to: VIEW Contest Winners List, 31014 South Coast Hwy, Laguna Beach, CA 92651

(P) The odds of winning will be determined by the number of entries.
